A Taraba State High Court sitting in Jalingo has reserved ruling until July 30, 2026, on an application seeking a review of the bail conditions granted to businessman and journalist, Gabriel Olayinka, who is standing trial over alleged criminal breach of trust and cheating.
Olayinka, who has been in custody at the Jalingo Correctional Centre since January 2026, is being prosecuted in a case instituted by Isa Jibril.
The matter arose from an earlier decision of an Upper Area Court in Jalingo, which admitted the defendant to bail on the condition that he deposits ₦100 million with the court registry and provides one surety before he can be released.
At the resumed hearing, counsel to the defendant, Barrister P.D. Pius, represented by Barrister L.L. Takdok, urged the High Court to vary the bail conditions, contending that they were excessive and had effectively denied his client the opportunity to regain his freedom.
Takdok argued that the dispute was essentially civil in nature and should not warrant such stringent bail terms. He urged the court to grant the application to enable the defendant exercise his constitutional right to bail.
Counsel to the complainant, Barrister D.G. Tukura, opposed the application and urged the court to strike it out, describing it as incompetent.
Tukura argued that the application failed to comply with the relevant provisions of the court rules, particularly Order 2 governing the filing of court processes. He further submitted that the defence did not specifically identify the aspect of the bail conditions it sought to be reviewed, rendering the application procedurally defective.
After hearing submissions from both counsel, the presiding judge, Justice Nuhu Adi, adjourned the matter to July 30, 2026, for ruling on the application for a review of the bail conditions.
