COURT: Plaintiff's Counsel's Absence Stalls Hearing in Olayinka's Criminal Case.

Proceedings in the criminal case instituted against the Chief Executive Officer of Taraba Business School, Taraba News and SumTV, Mr. Gabriel Olayinka, were on Monday stalled at Upper Area Court No. 11, Jalingo, following the absence of counsel to the complainant.

The matter, bordering on alleged criminal breach of trust and cheating, could not proceed after counsel representing the complainant, Mr. D.G. Tukura, informed the court that they were not prepared for the hearing.

Counsel to the defendant, Mr. L.L. Tadkok, of P.D Pius Chambers who spoke to journalists after the court session, said his legal team was fully prepared to commence hearing only to discover that the complainant's counsel was seeking an adjournment.

According to him, the defence team had complied with the hearing notice served on them and appeared before the court expecting the prosecution to open its case.

"We came to court today prepared to defend our client against the allegations of criminal breach of trust and cheating. However, we were surprised when counsel to the complainant informed the court that they were not ready to proceed and instead sought an adjournment to June 22, 2026," Tadkok said.

He explained that the complainant's counsel attributed their inability to proceed to an apparent discrepancy in the hearing date, noting that a notice served on them indicated June 16, 2026, while the matter was listed for hearing on June 15.

The defence counsel also pointed out that the endorsement on the warrant expected to produce his client in court bore the date of June 16, 2026, a development he said contributed to the delay in the substantive hearing.

Tadkok further disclosed that the complainant's legal team presented a letter to the court explaining that they were engaged in another matter before the Taraba State High Court and requested that the case be adjourned.

Despite expressing concern over the prolonged delay in the matter, the defence counsel said his team agreed to the request for adjournment in the interest of justice.

He expressed optimism that meaningful progress would be made when the case comes up again on June 22, 2026.

The complainant in the matter is represented by Mr. D.G. Tukura, Esq.
